ANNOUNCEMENT RELATING TO MAC AND BERKSHIRE HATHAWAY
What was the announcement?
A media release was issued by the Hon Rob Lucas (Treasurer) on the 8th of December 2018 relating to the future role Berkshire Hathaway (Reinsurer) will play in management of the MAC CTP claims back book (motor vehicle injury claims for accidents prior to 1/7/16).
The press release also states: “The existing Allianz claims management contract will remain in place at least until its current expiry of 30 June 2019. Claimants will not experience any change in their claims management experience”.
Who do I communicate with on my claim?
You should continue to communicate with Allianz or your lawyer in the manner you have previously done whether by phone, letter or email – on the same contact numbers and at the same address.
How will my claim be affected?
There is no change in your rights under the legislation. Normal claims payments, negotiation, settlements and other processes will simply continue. As MAC's Agent, Berkshire Hathaway are obliged to ensure ongoing compliance with MAC's legal obligations, including model litigant obligations. These obligations extend to any providers engaged by Berkshire Hathaway including the claims manager and legal providers.
Who do I communicate with on my clients claim? (For lawyers)
Plaintiff lawyers should continue to communicate with Allianz or MAC’s Defendant lawyers as per current arrangements.
Note: The information applies only to motor vehicle injury claims for accidents prior to 1/7/16 and lodged with Allianz as MAC’s claims manager.
